This privacy policy ("Privacy Policy") explains how Eminence Organic Skincare Inc., Eminence Certified Organic Farm, Eminence Virtual Tradeshow Booth and Eminence Kids Foundation (collectively, "Eminence," "we," or "us,") collects, uses, processes, discloses, and retains your personal data when you access or use our websites and any applications or products that display this Privacy Policy; send, access, or use any email, text, or other electronic messages between you and the same or in any correspondence between you and Eminence; and/or order or purchase any good, product, or service from Eminence (collectively, the “Services”). This Privacy Policy also applies to personal data we collect when you engage with our customer service, register for and attend our events, engage with us on social media or tradeshows, or otherwise interact with us.
Please review this Privacy Policy carefully. Our privacy practices are subject to applicable laws in the places in which we operate, which means we engage in the practices described in this notice in a particular country or region only as permitted under the laws of such jurisdictions.
IF YOU DO NOT CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY, DO NOT USE THE SERVICES AND DO NOT PROVIDE US WITH ANY PERSONAL INFORMATION. By accessing Eminence’s Services or submitting your personal data through the Services, you consent to the collection, use, and disclosure of personal data in accordance with this Privacy Policy and as otherwise permitted or required by law. When we receive personal data from you for the purposes of providing you with our Services or for other purpose(s) identified herein, you are providing us with consent for the collection, use, and disclosure of the personal data for the purpose(s) identified herein in accordance with this Privacy Policy.
If you are not resident in Canada and/or are located outside of Canada, you bear all responsibility for ensuring that your use of the Services is compliant with all applicable laws. Despite being a resident of Canada, at any time you use the Services outside of Canada, you bear all responsibility for ensuring that the use of the Services is compliant with the applicable laws of that jurisdiction.
Revisions to this Privacy Policy
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy. If we make material changes to this Privacy Policy, we will provide you with additional notice (such as adding a statement to our websites’ homepages or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you. Your access or use of the Services on and after the earliest date on which we post or provide notice of the revised Privacy Policy constitutes your acceptance of the Privacy Policy as revised. Examples of profile data we may collect include your name, email address, phone number, mailing address, account login name and password, and preferred language.

We may collect demographic data when you fill out forms or surveys or sign up for and participate in events, contests, sweepstakes, promotions, and special programs that we provide. Examples of such information include age and gender.
Transaction Data
We collect transaction information related to the use of our Services or your purchases. Examples of information collected include the type of products or services requested or provided, order details, delivery information, amount charged, payment method, credit card information, billing or shipping information, customization services for Eminence products, and information about any products or services you returned or exchanged with us. If you make a purchase, we work with third-party payment processors to collect and process your payment information.

We collect information when you communicate with us or others on our Services, such as when you request additional information about products or services, interact with our customer service teams, or sign up to receive our email newsletters or marketing messages. We also collect communications data when you interact with us on social media, such as by tagging us and/or our products or permitting us to follow your social media profile. Examples of such data may include your contact information, the date and time of your communications, online identifiers, social media profile, and the content of your communications.
User Content
We collect any other information or content you provide to us, such as when you rate products, provide design or product feedback, make other submissions to us, participate in any of our experiential or training offerings in tradeshows, events, masterclasses (or such), or use other features of our Services that may be offered from time to time, which may require the collection of certain personal data in order to utilize the features. Examples of user content may include information about your skin type, opinions, feedback, preferences, text, images, and any other personal data you choose to provide in your interactions with us.

We automatically collect certain personal data when you access and use our Services or shop in our stores. The types of information we collect may include:
Device and Network Data
We collect certain information about the device you use to access our Services. Examples of such data include your device’s hardware model, browser type, IP address, operating system version, language settings, unique device identifiers, advertising identifiers, serial numbers, screen resolution, usage and traffic data, how your device interacts with the Services, network information, and mobile network data.
Usage Data
We collect information about your activity on our Services via log files, cookies, web beacons, and other tracking technologies. Examples of such data include your access dates and times, pages or screens viewed, how long you spent on a page or screen, the routes by which you access our Services, searches you conduct on the Services, information about your activity on a page or screen, app crashes and other system activity, your use of any hyperlinks available within our Services, information about your interactions with our emails, your Internet service provider (ISP), Mobile Advertising ID, media access control (MAC) address, and identifiers associated with browser cookies, web beacons, and similar technologies we deploy on our Services (for more information about cookies and how to disable them, see the COOKIES section below).
Audio and Sensory Data
We may collect audio, video or sensory information from you. Examples of such data include sensory data when you participate in a product test requiring sensory data, video recordings when you visit an Eminence Booth at a tradeshow or participate in events or audio recordings when you call our customer service.
Location Data
We collect precise or approximate location information in accordance with your device permissions. You may use our Services without enabling us to collect location data from your device, however, this may affect some functionality available in the Services. For example, you may need to manually enter an address to find a Spa near you if you have not enabled location data collection. For more details, please see YOUR CHOICES below.
Personal Data We Collect from Other Sources
We may collect personal data about you from other sources. For example, we may collect personal data about you from:
- Publicly available sources;
- Carriers or other third parties when they provide your updated delivery and address information to us, which we use to correct our records and deliver your next purchase or communication;
- Third-party platforms, such as Facebook, X (formerly known as Twitter), Google, LinkedIn, and Instagram, that you use to interact with our Services (e.g., to create an account) or that allow you to provide information to us (e.g., via plugins, widgets or other tools), but always in accordance with the authorization procedures and privacy settings you establish with such services; and
- Unaffiliated parties, such as our service providers, analytics companies, marketing or advertising service providers, fraud prevention service providers, consumer data resellers, and other third parties that provide us with information, so we can better understand you and provide you with information and offers that may be of interest to you.

We may derive information or draw inferences about you based on the other types of personal data we collect. For example, we may infer your location based on your IP address, or your purchasing habits based on your browsing behavior on our Services.

- Respond to You: Respond to your requests and any other communications from you, including to provide customer service;
- Advertising and Marketing: With your prior consent, we will send advertising or marketing communications about products, services, offers, promotions, rewards, and events offered by Eminence and provide news and information that we believe may be of interest to you. Our marketing and advertising will be conducted in accordance with your advertising marketing preferences and as permitted by applicable law;
- Events and Offers: Offer, conduct, and administer events, classes, contests, prize draws, sweepstakes, and other promotions;
- Research and Development: Conduct research and development;
- Personalize Your Experience: Monitor, analyze, and audit your engagement with our brand and your interactions with our Services and online ads to better understand your interests and behaviors and customize your experience;
- Safety and Security: Detect and protect against malicious, deceptive, or illegal activity, including fraudulent transactions, error, negligence, and breach of contract, security incidents, and harm to the rights, property or safety of Eminence and our users, customers, employees, or others;
- Troubleshooting: Debug, identify, and repair errors that impair existing intended functionality of our Services;
- Your Consent: Complete, maintain, or support the performance of activities and/or Services requested by you; Process your personal data in accordance with your consent, intentional direction, or instructions;

- Reasonable Other Purposes: Carry out certain short-term activities and other reasonable purposes related to the products or Services you purchase from us or your ongoing relationship with us.
Disclosure of Personal Data
We share personal data for the purposes described below:
- With our Service Providers: We share personal data with unaffiliated companies or individuals we hire or work with that perform services on our behalf, including marketing, advertising, communications, customer service, IT services, data hosting, and payment processing;
- With our Professional Advisors: We share personal data with our legal, financial, insurance, and other advisors in connection with the management of all or part of Eminence’s business or operations;
- With Law Enforcement Authorities and Individuals Involved in Legal Proceedings: We share personal data when we believe doing so is reasonably necessary to comply with applicable law or legal process (including requests from authorities), to respond to claims, enforce or apply our Terms of Use, or to protect the rights, property, or personal safety of Eminence, our users, employees, or others;
- With Other Users of the Services or the Public: When you use features of the Services that are designed to make certain information publicly available to other users of the Services or the public at large. Examples of such features include user profiles, product ratings and reviews;
- As part of a merger or acquisition transaction but only to the extent required to evaluate the transaction and limited to those purposes;
- Third parties: We do not sell or disclose your personal data with third parties, except in accordance with this Privacy Policy;
- Aggregated, Anonymized, or De-identified Data: We share data in aggregated, anonymized, or de-identified form that cannot reasonably be used to identify you.
Advertising and Analytics Services Provided by Others
We may allow others to provide analytics services and serve advertisements on our behalf across the web and in mobile applications. Examples of such entities are Instagram, LinkedIn and others. These entities may use cookies, web beacons, device identifiers, and other tracking technologies to collect information about your use of the Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by Eminence to analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests, and better understand your online activity.
We may disclose your personal data to others to provide these analytics services and/or serve advertisements on our behalf across the web and in mobile applications.
Data Security
The security of your personal data is very important to Eminence. Eminence uses physical, electronic, and organizational measures designed to secure your personal data from loss or left, as well as unauthorized access, disclosure, copying, use, or modification.
Data Transfers and Retention
Data Transfers
We have operations and vendors in Canada and the United States. Therefore, we and our service providers may process, store, and/or transfer your personal data to, or store, access, or use it in, jurisdictions that may not provide equivalent levels of data protection as Canada. We will take steps to ensure that your personal data receives an adequate level of protection in the jurisdictions in which we process it. Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for, nor do we accept any liability for the privacy practices, policies, or content of third parties. Accessing, Correcting, and Deleting Your Personal Data
You may request to access or correct your personal data by contacting our Privacy Officer as described below. We may request certain information from you to verify your identity. In some cases, we may not be able to fully comply with your request, such as if it is unduly burdensome, jeopardizes the rights of others, or if we are required to retain information by law or for legitimate business purposes. We will notify you if we are unable to comply with your request and why.
Withdrawal of Consent
You may, at any time, withdraw your consent to Eminence’s collection, use and disclosure of your personal data, subject to reasonable notice and any legal or contractual restrictions. Should you choose to withdraw your consent, Eminence may be unable to provide, or continue to provide, the Services that can only be provided if Eminence receives appropriate and required personal data.
California Residents
In addition to the rights above, under California Civil Code Section 1798.83, known as the “Shine the Light” law, users who are California residents may request and obtain from us, free of charge, a list of any personal data and a description of the categories of personal data we disclosed to third parties for their own direct marketing purposes in the preceding calendar year, and the names and addresses of those third parties. To make such a request, please submit a request through our online form (here) <hyperlinked to Privacy & Data Request Form> and please include the phrase "Personal Information Privacy Request" in the subject line, the domain name of the website(s) you are inquiring about, along with your name, address and email address. At our option, we may respond to such requests by providing instructions about how our users can exercise their options to prevent our disclosure of personal data to third parties for their direct marketing purposes.
Minors
We do not knowingly target or collect personal data from children or adults who do not have legal capacity. Before providing any of their personal data to us, individuals under the age of 18 and any other individuals who do not have legal capacity should discuss whether or not to provide the information with their parent or guardian and make that decision together. The Sites are not intended for use by children under the age of 16. We do not knowingly collect or solicit any personal data from children under the age of 16. Should we learn that someone under the age of 16 has provided any personal data to us, we will remove that information as soon as possible.
Managing Communication Preferences
You may opt out of receiving promotional communications from us by following the instructions in those communications or by contacting us as described below. Please note that even if you opt-out of receiving promotional communications, we may continue to send you non-promotional (transactional) communications, such as those about your account, purchases, or our ongoing business relations.
